Arraigo sociolaboral vs socioformativo: which route fits you

Arraigo sociolaboral is for people who already have a job offer or contract of at least 20 hours a week. Arraigo socioformativo is for people who are enrolled, or about to enrol, in a recognised course. Both need two years of continuous presence in Spain, both last one year, and both are applied for inside Spain with no visa. They differ on the two points that matter most: how much you can work and what you must show to renew.

This guide compares them against the text of Royal Decree 1155/2024 (articles 125 to 132). For the other three routes, see our overview of the five arraigo routes.

Who this is for

Arraigo is for non-EU nationals who are already in Spain without a residence permit. That includes Americans, Canadians, Australians and Latin Americans. It also includes British citizens who arrived after 31 December 2020 and are not covered by the Withdrawal Agreement. If you were resident in Spain before that date and hold (or can obtain) a Withdrawal Agreement TIE, arraigo is not your route. EU citizens use the registration certificate (CUE) instead.

General requirements (article 126)

All of these must be met together, whichever route you choose:

  • You are in Spain and are not an international-protection applicant, either when you apply or while the file is processed.
  • You have been in Spain continuously for at least the two years before applying.
  • You are not a threat to public order, security or health.
  • You have no criminal record in Spain or in the countries where you lived in the five years before arriving in Spain.
  • You have paid the application fee.

Certificates from abroad usually need an apostille and a sworn translation; see our guide to criminal record certificates and apostilles. Article 130.2 waives third-country certificates if you have been in Spain continuously for the last five years.

You file in person at the immigration office. If documents are missing, the office gives you a deadline of no more than 15 days to fix it, or the file is treated as withdrawn (art. 130.3).

Arraigo sociolaboral (article 127.b)

You need one or more employment contracts that:

  1. guarantee at least the national minimum wage (or the collective agreement wage), pro rata to hours worked; and
  2. add up to at least 20 hours a week.

Several contracts are accepted for seasonal work (two or more, with different employers, one after another) and for simultaneous part-time work for more than one employer. For Mallorca’s hospitality season, that matters.

The employer must meet the conditions of article 74 except the national employment-situation test: a signed contract on lawful terms, up to date with tax and Social Security, and enough means to sustain the job. A company in arrears can sink a file even when the worker meets every requirement.

After approval, the permit only takes effect once you are registered with Social Security within one month (art. 130.5), and you must apply for your TIE within one month (art. 130.6). It allows work as an employee or self-employed, with no geographic or occupational limit (art. 131).

Arraigo socioformativo (article 127.d)

You must be enrolled in, or attending, one of:

  • full-time post-compulsory secondary education at an authorised school leading to a recognised qualification (including intermediate vocational cycles);
  • a complete (not modular, not partial) vocational training course leading to professional certificates at levels 1, 2 or 3;
  • face-to-face compulsory education for adults;
  • training promoted by the public employment services for occupations in the catalogue referred to in article 75.1.

At least 50 % of the course must be in person.

Deadlines to watch:

  • If enrolment has an official window, you apply in the two months before that window opens.
  • You must show proof of enrolment within three months of the grant notification, or the permit is extinguished.

This route also requires an integration report from the regional authority, which has up to one month to issue it once requested.

The catch: under article 131.b, this permit lets you work as an employee for a maximum of 30 hours a week, paid at least the minimum wage pro rata. Sociolaboral has no such cap.

Renewal (article 132)

File in the two months before expiry; filing in that window extends your current permit until a decision. Sociolaboral renewal requires proof that you are registered as a jobseeker at the public employment service. Socioformativo renewal requires a school report confirming promotion to the second year (basic or intermediate cycles), or, if you finished early, the diploma plus registered job search.

Which one?

A rough guide, not advice on your case:

  1. A contract of 20+ hours with a compliant employer? Sociolaboral.
  2. No offer, but willing to study an eligible course? Socioformativo, accepting the 30-hour cap and the integration report.
  3. Family ties to a foreign resident, or provable integration? Look at arraigo social.

Common mistakes

  1. Miscounting the two years (see our overview for the 90-day absence rule).
  2. A job offer under 20 hours, or below minimum wage pro rata.
  3. An employer with tax or Social Security debts.
  4. Enrolling in a course that does not qualify.
  5. Missing the post-grant deadlines: Social Security (1 month), TIE (1 month), enrolment proof (3 months).

FAQ

Can I work while my application is pending? No, not for an ordinary arraigo. See can I work while my application is pending?.

How long does the permit last? One year for both routes (art. 125.2).

Does a seasonal contract work? Yes, concatenated seasonal contracts with different employers are accepted if together they reach 20 hours and the minimum wage.

How long does the office take? The law sets a general three-month period; real timing depends on the office and cannot be guaranteed.
